By accessing or using CarsInStock ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
CarsInStock is a software platform that enables car salespeople to create their own digital storefronts, list vehicles for sale, capture leads, and communicate with potential buyers. CarsInStock is not a dealership, does not buy or sell vehicles, and is not a party to any transaction between a salesperson and a buyer.
To use the Platform, you must create an account with a valid email address and verify your email. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.
CarsInStock offers a 14-day free trial for new users. After the trial period, the Platform charges a $20.00 monthly subscription fee plus $2.00 per vehicle listed. Pricing is subject to change with reasonable notice. Payments are processed securely through Stripe. All fees are non-refundable unless otherwise stated. Pricing details are presented clearly during the checkout process prior to any charge.
If your account has an outstanding balance and payment is not received within 14 days, your account may be suspended and your storefront will no longer be visible to the public. If payment is not resolved within 60 days of suspension, CarsInStock reserves the right to delete the account and all associated data, including vehicle listings, leads, and profile information. We will make reasonable efforts to notify you via email before any deletion occurs.
All vehicle listings automatically expire after 7 days from the date of posting. This policy exists to maintain fresh, accurate inventory on the Platform. You may relist vehicles at any time. You are solely responsible for the accuracy of your listings, including pricing, vehicle condition, mileage, and photos.

You retain ownership of all content you post on the Platform, including vehicle photos, descriptions, and profile information. By posting content, you grant CarsInStock a non-exclusive, royalty-free license to display your content within the Platform to operate your storefront and deliver it to potential buyers. Any use of your content in external marketing materials will require your prior consent.
CarsInStock reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or uses the Platform in a way that harms other users or the integrity of the service. We will make reasonable efforts to notify you before taking action, except in cases of fraud or abuse.
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. CarsInStock does not guarantee uninterrupted access, error-free operation, or that the Platform will meet all of your requirements. We are not responsible for any transactions, disputes, or agreements between salespeople and buyers.
To the maximum extent permitted by law, CarsInStock shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to lost profits, lost data, or business interruption. In no event shall CarsInStock's total liability to you for all claims arising from or related to your use of the Platform exceed the total amount you have paid to CarsInStock in the twelve (12) months preceding the claim.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in the State of New Jersey. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
CarsInStock shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, power outages, internet service disruptions, government actions, or failures of third-party service providers.
You agree to indemnify and hold CarsInStock harmless from any claims, damages, or expenses arising from your use of the Platform, your content, or your violation of these Terms.
We may update these Terms from time to time. We will notify registered users of significant changes via email. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. To the extent that any dispute is not subject to arbitration as described above, you agree that such dispute shall be brought exclusively in the state or federal courts located in the State of New Jersey, and you consent to the personal jurisdiction of such courts.
New accounts include a 14-day free trial. During your trial, you may post vehicles at no charge. After your 14-day trial ends, you will be charged a $20.00 monthly platform fee plus $2.00 per vehicle posted. On or around day 11 of your billing cycle, you will receive an invoice via email for your platform fee and any vehicles posted during that cycle. Payment is due upon receipt. Accounts with unpaid invoices will be locked until payment is received.
